The 1st part was held the last thuesday, 15th May 2012, and has been accredited with 2 hours of structured CPE qualifying for the aMainment of Core Competencies in terms of the MIA CPE Regulations. The 2nd part was held today and has been accredited with 2.5 hours of structured.

Dr Panayi examined some interesting topics related to the CCCTB for EU group companies, as “The History of the proposal“, the “Basic principles, eligibility and group membership rules, the new common tax base“, the “Consolidation, formulary apportionment, administration of the system” on thuesady.
Today she analized the “International aspects – Taxation of outbound and inbound investment“, the “Anti-abuse rules – the GAAR, CFC and Thin Cap rules” and other recent developments.

«As far as the CCCTB is concerned, Malta will likely be affected whether it adopts the new proposal or not» - explained Dr Christiana Panayi - «If it adopts it, then it will have to provide an additional tax base. The CCCTB has rules for the calculation of the new tax base, depreciation, loss relief, intra-group transfers, reorganisations, the administration of the new system, taxation of inbound and outbound investment, anti-abuse rules and formulary apportionment. To the extent that these rules are different from the Maltese tax rules, they will encourage companies to opt for that system rather than the national one. One big difference is that intangibles are not to be taken into account in formulary apportionment which comprises of assets, labour and sales by destination. Therefore, when a Maltese company holding intangibles is part of a CCCTB group, then after the tax accounts are consolidated and the formula applied, it is unlikely to be apportionment part of the tax base. This may lead to loss of tax revenue».

«If Malta decides not to adopt the CCCTB and the proposal proceeds on the basis of enhanced cooperation under EU law, then it will be under a duty not to impede its implementation» - concluded the senior lecturer in Tax Law - «It is currently uncertain what this means. It may affect Malta’s rights to tax inbound and outbound investment into the CCCTB area».

These and a number of other issues were addressed by Dr Christiana HJI Panayi at the conference.

It was a very successfully day, starting with the video conference by Ms Julie de Bergeyck, MMM International’s European Delegation, who showed statistics of mothers in the workforce. Immediately after came the first “panel discussion”, in which the speakers were Ms Helen D’Amato (Commissioner for Children), Hon Dr Marie Louise (Coleiro MP), Dr Lydia Abela (Malta Labour Party) and Dr Marthese Portelli (President of PN Executvie Commitee).

The presentation by psycotherapist Ms Angele Licari on “Our Children - Our Teachers” was well received by the audience due to its reality, carefulness and honesty on the topic discussed. Same applied to the interview with Dr Charlotte Camilleri from the Malta Employers Association on the “Working Mothers, rights and obligations“.

The others two panels were very actively debated by the participants, who shared their experience. The first discussion tackled the topic of “Working Mothers - Not enought time?“, with the participation of Ms Joan Haber (Alka Ceramics), Ms Marie Louise Pace (PAL Malta), Ms Helga Ellul (Playmobil Malta), Ms Pauline Azzopardi ( HSBC Bank) and Ms Ruth Farrugia (Fino & Sons Ltd). The panel disussion, “Career Mothers - Breaking down the Maternal Wall“, with Ms Sandra Zammit (Smoochie Drinks), Ms Marisa Marmara (Majjistral Group), Ms Antoinette Caruana (Farsons), Ms Carmen Ciantar (Yellow Pages), Ms Claire Mifsud (Vodafone) and Ms Moira Farrugia (Bank of Valletta).

Ms Sandra Pollock, Chair of Women in Management CMI, concluded the conference with her speech on “Looking Forward - Example, Experience and Legacy” and affirming that mothers should view the event as a starting point to motherhood and carreers.

Traditionally, mothers have been associated with that comforting stable figure at the heart of the Mediterranean family; the person at home, providing for her children and husband. Yet the various developments that have taken place over the past decades, urge a rethink of our definition of mother particularly with the constant increase of single mothers, fostering and adoption and mothers’ in management.

Mothers who juggle career and family duties are faced with special challenges and concerns. Current conditions make it difficult to raise children while full-time employed. Thus, working women need to come up with a strategy that involves serious personal choices and sacrifices.

In this light, the Malta Institute of Management, as part of its 2012 conferences and events programme will organise on the 10th May the MIM National Congress for Mothers in Management where leading female entrepreneurs, managers and leaders will come together to discuss their personal experience in juggling work and family, discuss the current legislative framework, and outline proposals to help mothers in management

The half day conference will be held at the Westin Dragonara Resort, St Julians.
